I have specifically given you instructions on how to carry on with the business and its workability and the process is as simple as I have told you.  Your concern should be on the possibility of getting an account opened in United Kingdom.  Now, my question is this, if you are doing a business in United Kingdom, cant you open an account in United Kingdom?  And what we are simply doing at this point is to bring you in as a business associate, get your company registered with the corporate commission of united Kingdom through the bank, because, by assessing the bank’s online financial services all your entries will be fully incorporated and therefore make your bank account accessible while I stand as your gurantor and bear in mind at the same time, that banks have their respective and distinctive financial products which in most cases differs from banks to banks.  The bank of the financiers have a financial products that supports full offshore financial transactions.  And once that is done, the wire transfer will be effected to your nominated bank account in Indonesia without any huddles as it is going to be done through a direct swift wire transfer. And the whole transfers will now appear as a transfer from the same bank account holder. Moreover, I have already discussed it with the bank and they gave me their banking procedures and that is very simple.  Once that is done, your bank account with the bank will be credited and the wire transfer will be done immediately to their HSBC account, be converted to your home currency and transfered to your nominated bank account in Indonesia immediately.

Finally, bear in mind that I cannot proceed with the wire transfer processes if I have not drawn the binding memorandum of Understanding (MOU) and duely signed by the parties concerned as that is the binding agreement that should be in place before anything could be done. 

If you are cleared you let me know before I could proceed and bear in mind that we are presently running out of time and do not have much of the time again for arguments.

I will ask some multinational Banks which have branches at Indonesia about opening UK account based. If it is not possible, there are two alternatives I offer:

It appears you did not actually understood the present terrain in International transactions and especially, when it comes to foreign investments and the issues of capital flights and especially during this period of global economic melt-down that no countries allows for capital flights and that is one of the main reasons of expecting you to open an account in any of their nominated banks, once that is done, you will be expected to open the account with the same account name with your account in your home country and by so doing, the bank account will be deemed as an account by the same account holder and therefore, no restrictions will be imposed on it.  However, the issue of your home currency will not be a problem because once the funds are transferred to your bank account with the financiers bank, you can personally do the transfers to your nominated bank account with HSBC which operates in your home country. Finally, we accept to a profit sharing ratio of Class A equity of 50% profit sharing ratio, provided an adequate financial audited accounts will be made available to me for scrutiny quarterly.  I need your quick reply before I proceed with the drafting of a binding memorandum of understanding.

I am not interested on Loan for this Fund Management business Plan. If you (your clients) would like to lend me money,  I will be interested if you could give me credit limit up to (expandable loan) 10 billions USD. I could provide guarantee for that loan up to 100% from the loan usage (after I purchase assets by that loan money. I will do Leverage Buy Out style just like what http://www.kkr.com  did and do). The interest rate should be  floating with this formula: Central Bank Interest (based on the Currency we use on the loan) + X %. We could discuss the value of that X%. For example, if we use US Dollar as the currency base for the loan contract, and the X% = 1%. Then the loan interest rate will be The US Federal Reserve Rate + 1% month by month. 

Nevertheless, bear in mind that an assets management fees of 1% of the total investment funds of my client will be paid to me for my services once the investment funds are confirmed in your bank account.

I do not mind if you take 1% intermediator fee from your client's money.  I will not interfere negotiations you make with your clients. Every fees that will be paid to you will be shown openly on our company's accounting.

  Secondly i want you to bear in mind that no upfront payment will be demanded from any of the parties until the funds are confirmed in your designated bank account.

I prefer to use my own Indonesian Bank Accounts for receiving the loan/equity from your Clients. I could also open a Bank account on Multinational Banks such as CitiBank or HSBC. They have foreign currencies based bank account.

Alternatively, i can stand as your gurantor and assist you in linking you up directly through the bank’s online services. With this very arrangement you will not be required to travel, rather you will follow the bank online account opening instructions, contact the bank and open a business account with the bank and maintain your minimum bank deposit which still forms part of your funds and could as well be withdrawn at any point in time you desire.  The essence of opening the bank account in their nominated banks are:

1.       To ensure the protection of their funds.  By opening a bank account in your account name in your home country will assist them in making sure that the transfers are actually made in your bank account in your home country because, once the funds are transferred to your designated bank account in their nominated bank, the actual transfer will then be effected by you to your account in your home country and the transfers will be made in 3 consecutive transfers. You will be permited to make the first 20% immediately on the commencement of the project to your bank account at home and while the project is on and verified okay, the next 30% of the funds could be released, then thereafter based on your demand the remaining 50% will be released.

2.       Following the recent cases of global economic melt-down, no country permits a capital flight and in most cases a lot of international transfer restrictions have been placed by countries.  Therefore, once you have an operating bank account and transfers are made from the bank account to your nominated bank account, it will be viewed as an intra-transfer. That is a transfer made by the same account holder and therefore, no restrictions or excessive bank charges will be imposed on the transfer.

I think opening a foreign currencies based Bank account on Multinational Banks at Indonesia Branch will solve this problem. Secondly, we could use your clients' Government Embassy Office at Indonesia as the Intermediator for the transaction.
